With this tweet, Tim Sweeney makes an announcement that appears to be a defying Apple FINAL decision on keeping Fortnite banned from the App Store.

But more than being going unlawful, actually Epic Games might be referring to the new Europe Zone rule that forces Apple to make iOS capable of sideloading apps outside the App Store, a move that the Cupertino giant have been fighting for years appealing on platform security and integrity of iOS in general.

Unfortunately for Apple, the European Union did not buy that and by iOS 17, Apple is supposed to be complying with the Digital Markets Act.

The context here is that the legal saga between Epic Games and Apple started with Fortnite being updated in August 2020 that included a direct payment option in the game that circumvented Apple's in-app purchasing system, violating ‌ App Store ‌ rules. Apple ultimately removed Fortnite from the App Store, placing the blame directly on Epic for violating its rules.

But the move was a trap for Apple as Epic Games was already ready to sue Apple in the instant that Fornite got banned and of course, taking Google for the Android side of things too.

After many months of dirt sheets from Google, Apple and gaming industry in general being revealed, Epic And Apple were not total winners/losers as Fortnite being banned cannot be removed legally but Apple needs to permit developers to have alternative channels for making purchasing or subscription outside App Store.

Currently, both Epic Games and Apple had appealed their respectives negative outcomes of the lawsuit.
